1. Acceptance of Terms

By accessing or using the SportsRate mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and SportsRate.

2. Description of Service

SportsRate is a social cataloging platform for sports fans to:

• Rate and review sports games
• Discover and browse game information
• Follow other users and view their reviews
• Build a personal history of games watched
• Engage with the sports community

3. User Accounts

3.1 Account Creation

• You must be at least 13 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining the security of your account
• You must not share your account credentials with others
• One person may not maintain multiple accounts

3.2 Account Termination

• You may delete your account at any time from the app settings
• We may suspend or terminate accounts that violate these Terms
• We may terminate inactive accounts after 2 years of inactivity

4. User Content and Conduct

4.1 Your Content

You retain ownership of content you create (reviews, comments, etc.), but grant us a license to:

• Display your content in the app
• Store and process your content on our servers
• Show your public content to other users
• Use aggregated, anonymized data for analytics

4.2 Content Guidelines

You agree not to post content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Contains hate speech, discrimination, or promotes violence
• Infringes on intellectual property rights
• Contains spam, advertising, or promotional material
• Impersonates another person or entity
• Contains personal information of others without consent
• Is sexually explicit or inappropriate

4.3 Prohibited Activities

You agree not to:

• Use the app for any illegal purpose
• Attempt to gain unauthorized access to the app or servers
• Reverse engineer, decompile, or disassemble the app
• Use bots, scrapers, or automated tools
• Manipulate ratings or reviews
• Harass or abuse other users
• Interfere with the app's functionality

5. Intellectual Property

5.1 Our Content

The SportsRate app, including design, code, and branding, is owned by SportsRate and protected by copyright and trademark laws. You may not copy, modify, or distribute our content without permission.

5.2 Sports Data

Game data (scores, statistics, etc.) is sourced from ESPN's public API. Team logos and player images are property of their respective owners and used for informational purposes only.

5.3 Trademarks

Team names, logos, and related marks are trademarks of their respective leagues and organizations. SportsRate is not affiliated with or endorsed by any sports league, team, or organization.

6. Privacy

Your use of SportsRate is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the app, you consent to our privacy practices.

7. Disclaimers and Limitations of Liability

7.1 Service Availability

We strive to keep SportsRate available 24/7, but we don't guarantee uninterrupted service. The app may be unavailable due to:

• Maintenance and updates
• Technical issues or outages
• Third-party service disruptions
• Circumstances beyond our control

7.2 Data Accuracy

We source game data from ESPN's public API and cannot guarantee its accuracy, completeness, or timeliness. Game scores, statistics, and information are provided "as is."

7.3 User Content

We are not responsible for user-generated content (reviews, comments, etc.). User opinions do not represent our views. We reserve the right to remove content that violates these Terms.

7.4 Limitation of Liability

To the maximum extent permitted by law, SportsRate shall not be liable for any:

• Indirect, incidental, or consequential damages
• Loss of data, revenue, or profits
• Service interruptions or data inaccuracies
• Actions of other users

Our total liability shall not exceed $100 or the amount you paid us (whichever is less).

8. Indemnification

You agree to indemnify and hold harmless SportsRate from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your user-generated content
• Your use of the app
• Your violation of any rights of another party

9. Modifications to Terms

We may modify these Terms at any time. We will notify you of significant changes by:

• Updating the "Last Updated" date
• Sending an in-app notification or email
• Requiring you to accept the updated Terms

Continued use of the app after changes constitutes acceptance of the new Terms.

10. Modifications to Service

We reserve the right to:

• Add, modify, or remove features at any time
• Introduce premium features or subscriptions
• Discontinue the service with reasonable notice

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.

11.2 Dispute Resolution

Any disputes arising from these Terms or your use of SportsRate shall be resolved through:

1. Informal Resolution: Contact us to resolve the issue informally
2. Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration
3. Class Action Waiver: You agree to resolve disputes individually, not as part of a class action

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SportsRate regarding use of the app.
